Terms of Service

1. Agreement

By creating an account and using Smoothfunnels ("the Service"), you agree to these Terms of Service. If you do not agree, do not use the Service.

2. The Service

Smoothfunnels is an AI-powered platform that helps marketing agencies generate funnel strategies, SEO landing pages, and website analyses using Claude AI by Anthropic. The Service is provided on a subscription basis with a credit system.

3. Account

• You must be at least 18 years old to create an account
• You are responsible for maintaining the security of your account credentials
• You must provide accurate information when registering
• One person or legal entity may not maintain more than one free account

4. Subscriptions & billing

• Subscriptions are billed monthly or annually via Stripe
• Credits included in your plan are granted at the start of each billing period
• Unused credits carry over month to month while your plan is active
• You can upgrade, downgrade, or cancel your subscription at any time via the billing dashboard
• Downgrades take effect at the end of the current billing period
• Prices are shown in EUR and exclude VAT where applicable

5. Refunds

We do not offer refunds for subscription periods already paid, except where required by applicable law. If you believe you were charged in error, contact hello@smoothfunnels.ai within 14 days.

6. Credits

• Credits are consumed per AI action (website analysis, funnel generation, landing page generation)
• Credits are only deducted after a successful AI response — failed calls are automatically refunded
• Credits have no cash value and cannot be transferred between accounts
• Credits expire if your subscription is cancelled

7. Acceptable use

You agree not to use the Service to:

• Generate content that is illegal, harmful, fraudulent, or misleading
• Violate the intellectual property rights of others
• Spam, scrape, or abuse the AI generation system
• Attempt to reverse-engineer, hack, or disrupt the platform
• Resell or sublicense access to the Service without written permission

8. Content ownership

You own the content you generate using Smoothfunnels. We claim no ownership over funnels, landing pages, or other output you create. By using the Service you grant us a limited licence to process your inputs to provide the Service.

9. AI-generated content

Content is generated by Claude AI (Anthropic). AI outputs may occasionally be inaccurate, incomplete, or unsuitable. You are responsible for reviewing all generated content before publishing or distributing it. Smoothfunnels makes no guarantees about the accuracy or suitability of AI-generated content.

10. Uptime & availability

We aim for high availability but do not guarantee uninterrupted access to the Service. Scheduled maintenance will be communicated where possible. We are not liable for losses resulting from downtime.

11. Limitation of liability

To the maximum extent permitted by law, Smoothware's total liability for any claim arising from use of the Service is limited to the amount you paid in the 3 months preceding the claim. We are not liable for indirect, incidental, or consequential damages.

12. Termination

We reserve the right to suspend or terminate your account if you violate these Terms. You may cancel your account at any time from the billing dashboard. Upon termination, your data will be deleted within 30 days.

13. Governing law

These Terms are governed by Dutch law. Any disputes shall be submitted to the competent court in the Netherlands.

14. Changes

We may update these Terms. Material changes will be communicated by email at least 14 days before taking effect. Continued use of the Service after changes constitutes acceptance.
